ImageWASHINGTON, District of Columbia USA — Assistant United States Attorney Channing D. Phillips, acting counsel for the defendant Bureau of Alcohol, Tobacco, Firearms and Explosives, filed a motion in U.S. District Court this past Friday seeking an extension to file a timely response in opposition of the return of attorney's fees sought by plaintiffs Tripoli Rocketry Association and the National Association of Rocketry.

Citing myriad reasons, including the fact that the defense attorney with daily responsibility for this case, Jane M. Lyons, was on vacation, the Defendant's Unopposed Motion for Extension of Time to File Opposition to Plaintiffs' Motion for Attorney's Fees and Costs asked the court for an extension to legally file their response from June 29th, 2009 to July 13th, 2009.

The motion was unopposed by the plaintiffs being granted by the court according to the filing. The plaintiffs' motion, filed in U.S. District Court on June 13th, 2009, seeks over $395,000 in fee recovery in the landmark hobby rocketry lawsuit seeking relief from ATF regulation of ammonium perchlorate composite propellant (APCP).

Oh now they finally reply very fast! lol They made us wait and try to wear us down for 9 years. We complied to everthing. Even after we won we waited 60 day's up until the clock struck midnight! Now they can't handle a little lawsuit. Because someones on Vacation! lol

Now it will take 9 years to get the money back.
They will appeal, fight, delay all the way.

The good news is it is a motion. The longest motion in this case only took 2 years. The one ending it.

The longer they draw this out, the more legal fees they might have to repay, right?

Oh! how right you are my friend. The more they postpone. The more money I would think. They will have to pay! So if they like cutting there own throats well let them slice away lol

The problem is that if they ever pay out any money it is tax payer money through the ATF, and it doesn't do a thing to the perpetrators. Basically they get off scott free for breaking their own laws. The money should come out of the pockets of the individuals that caused the problem. Just my 2 cents.

Unfortunately, they don't have to pay anything. They just steal it from the taxpayers. And their children. And their grandchildren. YES, THEY CAN!

At a minimum it ought to reduce their budget by the amount lost on judgment during the next several years if the was any justice.
